Please read these Terms of Service carefully before using the 8vests platform. These Terms set out your rights and obligations as a user and the rules that govern your relationship with us.
1. Acceptance of Terms
By accessing or using the 8vests platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. 8vests reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age and legally permitted to invest in your jurisdiction to use the Platform. By registering, you represent and warrant that you meet these requirements. The Platform is not available to residents of jurisdictions where P2P lending or crypto investment is prohibited.
3. Account Registration & KYC
To access investment features you must create an account and complete Know Your Customer ("KYC") verification. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. 8vests reserves the right to suspend or terminate accounts that provide false information.
4. Investment Risks
Investing through the Platform involves risk, including the possible loss of principal. Past performance of any project is not indicative of future results. 8vests does not guarantee any returns. You should only invest funds you can afford to lose and should seek independent financial advice if necessary. All investments are subject to borrower default risk, liquidity risk, and regulatory risk.
5. Platform Fees
8vests charges borrowers origination and servicing fees. Investors pay no direct platform fees. Blockchain gas fees are the investor's responsibility and may vary based on network conditions. Fee structures are disclosed on individual project pages and may be updated from time to time.
6. Collateral & Buyback
Certain projects on the Platform are backed by real-world collateral registered through our partner Maclear AG. Where a BuyBack guarantee is indicated, Maclear AG will repurchase the loan if the borrower delays payment by more than 60 days. Buyback protection does not apply to all projects. Users should review each project's terms individually.
7. Prohibited Activities
You agree not to: (a) use the Platform for money laundering or terrorist financing; (b) attempt to circumvent KYC/AML checks; (c) manipulate project listings or investor metrics; (d) use automated bots to access the Platform without written permission; (e) post false, misleading, or defamatory content; or (f) violate any applicable law or regulation.
8. Intellectual Property
All content on the Platform — including text, graphics, logos, and software — is owned by or licensed to 8vests and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content without our express written consent.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection and use of your personal data as described in the Privacy Policy.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. 8VESTS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, 8VESTS DISCLAIMS ALL WARRANTIES AND LIABILITY FOR ANY LOSSES ARISING FROM YOUR USE OF THE PLATFORM.
11. Limitation of Liability
To the fullest extent permitted by applicable law, 8vests and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any investment made through it.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Basel, Switzerland.
